These Terms govern use of daile.art and purchases from DAILE. By using the store or placing an order, you agree to these Terms together with the Privacy, Shipping and Refund Policies. Mandatory consumer rights prevail where they provide greater protection.

2. Store use and eligibility
You must have legal capacity to enter a contract, or permission from a parent or guardian where permitted. You may not misuse the store, interfere with security, submit malicious code, scrape protected content or use DAILE for unlawful activity.
3. Products and creative presentation
DAILE sells premium art puzzle gift sets, personalised photo puzzles, limited editions and related gift components. We aim to display products accurately, but screen colours, material grain, print position and handcrafted details can vary slightly. These natural or technically unavoidable differences are not defects where the product remains consistent with its description and approved personalisation.
Product availability, specifications and packaging may change. We will not materially substitute a paid item without approval.
4. Orders and contract formation
Your checkout submission is an offer to purchase. An order is accepted when we send confirmation and can fulfil it. We may reject or cancel an order for genuine availability, payment, fraud, pricing, technical, legal or content-rights reasons. If we cancel after payment, the affected amount will be refunded.
You are responsible for checking product choice, quantity, personalisation, spelling, delivery details and contact information before submitting the order.
5. Prices, payment and promotions
Prices and currency are shown at checkout. Applicable taxes, shipping, discounts and the final payable amount are displayed before payment. DAILE uses third-party payment providers and does not store full payment-card details.
Promotions may have stated dates, eligible products, markets and minimum values. Unless expressly allowed, discount codes cannot be combined, exchanged for cash or applied retrospectively.
6. Personalised products and uploaded content
By uploading a photo, artwork, name, message or other content, you confirm that you own it or have all permissions required to use it and that it does not infringe privacy, copyright, trademark or other rights. Do not submit illegal, abusive, exploitative or harmful content.
You grant DAILE and involved production providers a limited, non-exclusive licence to process, adapt, print and reproduce the content solely to create the preview, manufacture and support your order. Ownership of your original content remains with you.
We may reject content that appears unlawful, unsafe or infringing. Personalised and made-to-order products are subject to the limitations in the Refund Policy.
7. Artwork and DAILE intellectual property
DAILE branding, product concepts, packaging, website design, text, photography, videos, graphics and original artwork are owned by or licensed to DAILE and protected by law. Purchase of a physical product does not transfer reproduction, commercial-use or digital-distribution rights unless agreed in writing.
8. Shipping, delivery and risk
Production methods, estimates, tracking, duties and delivery procedures are described in the Shipping Policy. Delivery dates are estimates unless expressly guaranteed. Risk of loss remains with DAILE until goods are delivered to you or a person you nominate, except where applicable law provides otherwise.
9. Returns, defects and refunds
Withdrawal rights, personalised-product exclusions, damage claims and refund procedures are described in the Refund Policy. Nothing limits statutory rights for defective or non-conforming goods.
10. Reviews and communications
Order-related messages are necessary to provide the service. Marketing is sent only where legally permitted and can be unsubscribed from. If you submit a review or public response, you permit DAILE to display it in connection with the store, subject to law and platform terms.
11. Third-party services
The store relies on Shopify, payment providers, personalisation tools, analytics and carriers. Their separate terms may apply to functions they operate. External links are provided for convenience; DAILE does not control unrelated third-party content.
12. Availability and warranties
We take reasonable care to keep the store accurate and available, but uninterrupted or error-free access cannot be guaranteed. Any exclusion of warranties applies only to the maximum extent permitted by law and does not remove mandatory consumer guarantees.
13. Liability
DAILE is responsible for loss that is a foreseeable result of our breach or negligence. To the maximum extent permitted by law, we are not responsible for indirect business losses, lost profits, loss caused by unlawful uploaded content, or delay caused by events outside reasonable control. Nothing excludes liability that cannot legally be excluded.
14. Force majeure
DAILE is not responsible for delay or failure caused by events beyond reasonable control, including natural disasters, war, conflict, sanctions, airspace or carrier restrictions, strikes, epidemics, power or network failures and government action. We will take reasonable steps to reduce impact and communicate material delays.
15. Governing law and disputes
These Terms are governed by the laws of the Republic of Latvia. If you are a consumer, this choice does not deprive you of mandatory protections under the law of your country of residence. Contact info@daile.art first so we can try to resolve concerns promptly.
16. Changes and severability
We may update these Terms prospectively when the store, products or law changes. The version applicable to an order is the version in effect when it was placed, unless mandatory law requires otherwise. If one provision is unenforceable, the remaining provisions continue.
